1. Applicability
These General Terms and Conditions (GTC) apply to all shipments of the Linde Eckstein GmbH + Co. KG Web Shop to consumers (Section 13 of the German Civil Code (BGB)). Linde Eckstein GmbH + Co. KG generally reserves the right to refuse any order of products of abnormal nature, in particular orders with quantities and/or values that Linde Eckstein GmbH + Co. normally considers not normal (atypical, non-household quantities).

3. Offer and Contract Conclusion
3.1 The presentation of the products in our online shop does not constitute a legally binding offer, but merely an invitation to place orders. Unless indicated otherwise for the products, all offers are subject to availability. Errors excepted.
3.2 By clicking the "Submit Order" button in the last step of the order process, you place a binding order for the goods in the shopping cart. A purchase contract will come about if we accept your order with an order confirmation by e-mail immediately after receiving your order.
3.3. Linde Eckstein GmbH + Co. KG reserves the right to reject the fulfilment of a customer’s order, if the order seems abnormal, exaggerated or in case it might violate the provisions of the terms and conditions.
4. Customer registration
4.1. New customer registration is free of charge and possible starting from the age of 18 years. By clicking the “Register“ button the customer acknowledges acceptance of these terms and conditions as well as his/her age of legal maturity. The registration requires that all personal information entered is true and complete. Linde Eckstein GmbH + Co. KG is authorized to exclude persons from the registration for justifiable reasons, as for example the violation of the registration terms, a previous exclusion because of non-compliance with the registration terms, double or multiple registration using different e-mail addresses, undue influence by third parties, manipulation etc. In such cases, gifts, other free additions or offers connected with the new customer registration, can subsequently be denied and reclaimed.
4.2. Linde Eckstein GmbH + Co. KG reserves the right to change the registration terms or to discontinue the registration process completely or partially for a serious reason without prior notice at any time. This applies in particular if circumstances arise that may interfere with or prevent the registration process, as for example in case of manipulations or manipulation attempts that affect the regular and proper execution of the registration. If an interruption or termination is due to the behavior of the new customer, Linde Eckstein GmbH & Co. KG shall be entitled to demand compensation from the new customer for any damage incurred as a result.

6. Right to Cancel and Information on the Right to Cancel
6.1 Right to Cancel
You may cancel this contract within 14 days without specifying reasons.
The cancellation deadline is 14 days from the date on which you or a third party designated by you, who is not the carrier, take(s) possession of the goods.
To exercise your right to cancel, you need to send an explicit declaration (e.g. a letter, fax or e-mail) of your decision to cancel this contract.
For this, you may, but are under no obligation to, use the enclosed cancellation template.

To comply with the cancellation deadline, you merely need to send the notice of exercise of the right to cancel before the cancellation deadline is reached.
6.2 Consequences of Cancellation/Information on the Right to Cancel
If you cancel this contract, we will without delay refund all payments we have received from you, including the shipping costs (except for any additional costs in case you chose a shipment method other than the most inexpensive standard shipment offered by us), at the latest within 14 days from the date on which we received the notice of your cancellation of this contract. For this refund, we will use the same payment method that you used for the original transaction, unless expressly agreed otherwise; by no means will we charge you for any refund fees. We may withhold the refund until we receive the goods back or until you furnish evidence that you have sent the goods back, whichever happens earlier.

without delay, in any case within 14 days from the date on which you inform us of the revocation of this contract. This period will be deemed complied with if you despatch the goods prior to the end of the 14-day period. You shall bear the direct costs of the return shipment.
You will only be required to compensate any loss of value of the goods if such loss of value is the result of any handling of the goods that was not necessary for testing their condition, properties and function.
7. Prices and Shipping Costs
7.1 The prices quoted on the product pages include statutory value-added tax and other price components.
7.2 The shipping costs amount to €3.95 within Germany and €7.95 to Austria and will be clearly communicated to you before you place your binding order. An overview is available on the "Shipping" page. Shipment to Austria is free for registered customers placing a minimum order value of € 50,00, whereas shipment within Germany is free for registered customers placing an order worth at least € 20,00. Shipment within Germany is free for unregistered customers placing a minimum order value of € 49,00.
8. Delivery
8.1 Delivery is only within Germany and Austria.
8.2 The delivery time is up to 3 days.
9. Payment
9.1 The payment takes place via "Pay now" or PayPal Checkout (PayPal, SEPA direct depit, giropay, SOFORT, debit- or credit card)
9.2 In the case of payment by credit card, the amount will be charged to your credit card account upon placement of the order.
10. Retention of Title
The goods remain property of Linde Eckstein GmbH + Co. KG until full payment is made.
11. Warranty and Damages
11.1 Linde Eckstein GmbH + Co. KG will eliminate defects in quality by delivering flawless goods within a reasonable period. If the supplementary performance fails, is unacceptable to the customer or is rejected by Linde Eckstein GmbH + Co. KG because this is justified under consideration of the interests of both parties, the customer shall be entitled to the statutory rights to rescission, reduction and, if applicable, damages and compensation of expenses in the scope described below.
11.2 Liability for damages is disclaimed for breaches of obligations by way of slight negligence, provided that they do not pertain to material contractual obligations and/or damage from injury to life, body or health or breaches of guarantees. This does not affect claims under the German Product Liability Act (ProdHaftG). The disclaimer also applies to breaches of obligations by our agents and legal representatives.
